Family Law

Divorce and separation are difficult even under the best of circumstances. They can become even more complicated when there are children involved. At Howard & McBeath, we have years of experience in all aspects of family law, so we understand your concerns and can help you find your way through this complicated process.

Our attorneys have spent much of their careers working closely with clients to find the best solution for them and for their children. Each case is different, and we know that taking the time to learn about the family dynamics and our clients' hopes for their futures makes a big difference in the outcome of the case. We are committed to helping you protect what you have worked so hard for.

We can assist you with questions that may arise prior to filing for divorce, as well as with many issues that come up throughout the divorce proceedings. We will explain the steps of the process to you, represent you at scheduled hearings, and prepare the appropriate paperwork for your case. Our firm is experienced in all aspects of family law, including the following:

  • Petitions for Divorce or Separation
  • Parenting Plans
  • Child Support (initial orders or modifications)
  • Alimony/Spousal Support
  • Property Division
  • Post-Divorce Issues (Modifications, Contempt Orders, QDRO Preparation)

QDRO

A Qualified Domestic Relations Order, or QDRO (pronounced "QUADRO") is a court order that allows a retirement plan to be divided in certain circumstances, so that the plan participant and another person (called an Alternate Payee) each receive a share. Many times in New Hampshire divorces, the court will allocate a portion of one spouse's retirement plan to the other spouse. A QDRO can also be used to pay child support and/or alimony to another person. In order to actually split the account, specific paperwork, which is in compliance with federal law, must be submitted to the plan. Our lawyers have extensive experience in QDRO preparation and would be happy to discuss your case with you.

Unbundled Services or Limited Representation

If you would like to handle most of your case yourself, but need help with some aspects of it, our firm can provide unbundled legal services. This means that we assist with only certain parts of the case, while you manage the rest. For example, many clients would like help with document preparation, or perhaps representation at hearings, but feel secure handling the remainder without legal counsel. We have assisted clients with the following matters on an unbundled basis:

  • Drafting Petitions and Motions
  • Drafting or Reviewing Agreements
  • Representation at Settlement Conferences or Mediations
  • Providing Advice on Specific Matters
  • Representing Clients in Court at Hearings
  • Helping Compile Answers to Interrogatories/Requests for Production of Documents
